Terms and conditions of sale
Section 0 – Preamble
These General Conditions of Sale of the engine-bronze.com site apply exclusively between the company Les Ateliers du Lignon (hereinafter «Company») and any customer (hereinafter «Customer») of the engine-bronze.com site making a purchase via the Site. Les Ateliers du Lignon le Bourg 42600 Chalain le Comtal is active in the manufacture and sale of artistic works and decorative elements. The T&Cs define the rights and obligations of the parties in connection with the sale of products on the Site. The GCS are the only ones applicable and replace all other conditions, unless otherwise agreed in advance, express and written by the «Company». At any time, the «Company» reserves the right to adapt or modify certain points of the GTCS. Consequently, it is necessary to read the version in force on the day of placing the order on the Site. These adaptations or modifications are enforceable against the user from the moment they are posted online and will apply to orders placed after they are posted online.
Section 1 – Customer Account
Any professional user of the Site engine-bronze.com has the opportunity to open an account in which personal information about him appears. Any order placed on the engine-bronze.com by a professional requires the creation by the Customer of an account. Access to this account is protected by a username and password. When opening the account, the Professional Customer acknowledges having read and accepted the GTC by checking the box provided for this purpose. The Customer will be engaged by any order placed from his account. It is therefore up to the Customer to protect the confidentiality of his username and password. motor-bronze.com reserves the right to suspend or close the account of a Customer who contravenes the stipulations of the GTC, as well as the legal and regulatory provisions in force in France.
Section 2 – Contract
The contract is deemed concluded between the parties at the time of acceptance of payment for an order by engine-bronze.com. Acceptance of payment for an order will vary depending on the payment method chosen by the Customer. In order to best fight against fraudulent orders by credit card, moteur-bronze.com reserves the right to ask the customer for a supporting document (ID, proof of address, etc.) to validate the shipment of the order. In the event of failure to receive the requested supporting document within 48 hours, moteur-bronze.com reserves the right to cancel the customer’s order and therefore refund the customer. Acceptance of the payment of an order by motor-bronze.com implies acceptance by the Customer of the GTCS in force on the date of placing the order. The contract is valid until the execution of the Customer’s order. By accepting these Terms and Conditions, the Customer declares to have the legal capacity to conclude a contract according to article 1123 and following of the Civil Code.
Section 3 – Products
The products displayed on the site are available for sale. motor-bronze.com makes available to the Customer, as an indication, a descriptive sheet and pictures of the products offered for sale. The photos of the products are not contractual. The products are offered for sale for a fixed period. motor-bronze.com reserves the right to change the period of sale of the products offered without being liable.moteur-bronze.com reserves the right to decide on the availability of products based on the place of delivery (Country, islands, etc..etc.)
Section 4 – Product Availability
Product offers are valid as long as they are visible on the Site. Nevertheless, due to the unit production method, their availability and the estimated delivery time will be mentioned to the customer in response to the form, sent by the latter, located on the order modalities page. Upon acceptance of an order, a purchase confirmation email will be sent by motor-bronze.com to the Customer who placed an order summarizing the products ordered. Only receipt of the purchase confirmation email by engine-bronze.com guarantees product availability. However, due to the unit production method, after placing the order, moteur-bronze.com reserves the right to suspend the sale of a product in case of unavailability. In this event, moteur-bronze.com will inform the Customer as soon as possible by email and propose to the Customer either to put on hold or to cancel his order. If the order is placed on hold, moteur-bronze.com will offer the Customer a new estimated delivery time. In case of agreement with the Customer,moteur-bronze.com will ask the Customer for a deposit of 10% of the order. In case of cancellation by the Customer of his order, moteur-bronze.com will refund, on the credit card used during the order, by bank transfer or by PayPal the possible amount paid by the Customer when ordering within a maximum period of fourteen (14) days from the Customer’s decision.
Section 5 – Ordering methods and prices
5.1 Order
Orders are placed exclusively on the Site. Any other form of order will not be accepted, unless prior written agreement of engine-bronze.com. Upon validation of the order, a payment link will be sent to the Customer who will be redirected to a window allowing him to access and validate his payment. Any order will be accepted by motor-bronze.com only at the time of recording the payment by the Customer of his order. Any order accepted by motor-bronze.com will result in sending to the Customer on the email address used to place the order of a purchase confirmation email summarizing the products ordered and the delivery address. It is the Customer’s responsibility to ensure that the confirmation email sent by engine-bronze.com is not blocked by an email filtering device. motor-bronze.com cannot be held responsible for blocking or erasing the purchase confirmation email regardless of the device in question. Only the purchase confirmation email guarantees the Customer the availability of the product ordered, subject to Article 4 above. motor-bronze.com reserves the right to cancel an order in the event that the Customer commits payment fraud or any other criminal offence.
5.2 Price
The prices displayed in euros on engine-bronze.com are prices including VAT on the description sheet, but excluding delivery costs, the latter being specified during the validation of purchase. If customs duties, local taxes or import duties are due, these duties are the responsibility of the Buyer and are their sole responsibility, both in terms of declarations and payments to the competent authorities and/or bodies. It is his responsibility to inquire with the competent authorities. Despite all the care taken by engine-bronze.com, the prices displayed on the Site may contain errors. In this event, moteur-bronze.com cannot be held responsible for such errors and moteur-bronze.com reserves the right to cancel any order when such errors occur. It is possible that the Customer’s payment currency differs from the currency in which the prices are displayed. In the event that the Customer’s banking institution applies an exchange rate to the transaction between the Customer and moteur-bronze.com, the Customer shall exclusively bear the exchange fees applied by its banking institution. Due to an adapted commercial policy and different constraints (logistics, etc.), moteur-bronze.com reserves the right to sell a product at a different price depending on the country of delivery of the order.
5.3 Delivery costs
Delivery costs depending on the country will be specified in response to the form located on the order modalities page
5.4 Price changes
motor-bronze.com reserves the right to change without notice the prices of the products in the section «coming» and/ or «on sale» in case of fluctuation in raw material costs or for any other reason. The price applicable to a product is the price appearing on the Site at the time of the order.
Section 6 – Payment
The payment of the products is done by bank transfer, credit card, bank check or PAYPAL account. motor-bronze.com cannot be held responsible for losses and any damages resulting from any attempt to pay by a means of payment other than those mentioned in the GTCS. The price to be paid is that indicated on the Site at the time of purchase. It corresponds to the cumulative price of the products ordered. This final price will be indicated to the Customer at the «order verification» stage, before payment of the order. In accordance with Article 4 above, moteur-bronze.com recalls that any sale is concluded under the condition precedent of the availability of the product and the receipt of a confirmation sent by moteur-bronze.com to the Customer.
Section 7 – Securing payments
motor-bronze.com has chosen efficient and rigorous tools in terms of securing payment methods. engine-bronze.com has adopted the PayPal solution, leader in online payment, using the SSL (Secure Socket Layer) encryption method and 3D Secure, the most efficient security systems at present, and establish an encrypted connection directly between the Buyer and the bank. motor-bronze.com has no access to confidential information relating to the means of payment that the Customer uses during payment.
This is why the Customer’s bank details will be requested with each new order. Indeed, only PayGreen has confidential information that remains inaccessible to third parties. motor-bronze.com uses encrypted security software, the security of information and payments transmitted over the Internet or via email cannot be guaranteed. motor-bronze.com cannot be held liable for damages resulting from the use of electronic means of communication, including (but not limited to) damages resulting from a failure or delay in the transmission of electronic communications, the interception or manipulation of electronic communications by third parties or by computer programs used for electronic communications and for the transmission of viruses.
Section 8 – Delivery
For all confirmed and paid orders, the preparation of the order and its shipment take place within 7 working days of receipt of payment, to which is added the delivery time. Delivery times are given in working days (excluding weekends and public holidays) and are indicative according to the delivery method. The order will be delivered to the address indicated by the Customer when registering on the Site or placing the order (for delivery to a different address, the fields of the delivery address must be completed). For any error in the delivery address entered by the customer, moteur-bronze.com cannot be held responsible. The costs of returning the order will be borne by the customer. In the case of delivery to a collective address, the Customer acknowledges that the obligation of the company for the delivery of the order stops at the actual delivery to the collective address indicated in its order form, even though the shipment is not received by the final recipient but by a third party. In the event that the Customer wishes to change the delivery address after placing his order, he must send as soon as possible an email to customer service at the following address: moteur-bronze@laposte.net recalling the order number, the product concerned and specifying the new delivery address. motor-bronze.com will then send, depending on the status of the Customer’s order, a confirmation email authorizing or refusing the modification of the delivery address. Any additional costs and expenses generated by the change of the delivery address will be the sole responsibility of the Customer. motor-bronze.com reserves the right to accept or refuse the request to change the delivery address. In case of damage (damaged product), the Customer must IMPERATIVELY
refuse the product delivered at the time of delivery and confirm its reservations within three (3) working days following the date of delivery by email to moteur-bronze@laposte.net. In case of refusal of a product, the return shipping costs will be the exclusive responsibility of the customer.
Section 9 – Right of withdrawal
In accordance with the legal provisions in force, the Customer has a period from the order and up to fourteen (14) working days after the day of delivery of the products to exercise his right of withdrawal from engine-bronze.com without having to justify reasons or pay penalties. In case of exercising the right of withdrawal, the Customer must first inform moteur-bronze.com by email at the following address: moteur-bronze@laposte.net. The email sent will be the effective date of exercise of the Customer’s right of withdrawal. To allow the return of the product in the best conditions, moteur-bronze.com will select the mode of transport, as well as the identity of the carrier. The Customer expressly renounces to return any product without consulting engine-bronze.com beforehand. In case of exercise of this right of withdrawal within the period referred to above, only the price of the returned product and the delivery costs indicated in the order will be refunded. Costs and risks of return remain the sole responsibility of the Client. Any return of product under this article must be made in the original and complete condition of the product (packaging, accessories, etc.) in order to allow its resale. A copy of the sales invoice or order confirmation must also be returned with the product. Any product returned must be shipped to the address indicated by engine-bronze.com. Any product returned incomplete or damaged will not be taken back under the right of withdrawal. Any refund under this article will be made by refund to the credit card used for payment, by bank transfer or by PayPal within fourteen (14) days of the date on which the returned product is received by engine-bronze.com. In case of cancellation of orders,
the fees charged at the time of the order related to the use of the PayPal account and the delivery costs will not be refunded.
Section 10 – Copyright and reproduction rights
The entire site is subject to French and international legislation on copyright, image rights and intellectual property. All rights of reproduction are reserved. The total or partial reproduction of the elements of this site (Photos, images, texts. , regardless of the medium, is strictly prohibited unless expressly authorized in writing by moteur-bronze.com.
Section 11 – Personal data
The databases of engine-bronze.com have been declared to the CNIL. motor-bronze.com reserves the right to collect data about the Customer, including the use of cookies. See the privacy policy and cookies at the bottom of the site. Through the operation of the Site, the Customer consents to the use of his personal data, data communicated when registering, by the services of engine-bronze.com in charge of order processing. These data are necessary for the processing of his orders but will never be transmitted to others. In accordance with the law “Informatique et Libertés” n°78-17 of 6 January 1978 amended in 2004 and the General Data Protection Regulation, GDPR, on 25 May 2018, the Customer has the right to access, rectify and delete data concerning him. He may also object to his data being transmitted to third parties.

11.3. Processing your orders
We process your Data in order to process your orders. This processing has for sub-purposes the management of the customer relationship, the after-sales service, and the Mediation service, the management of the Distance Selling service, the management of the customer relationship via social networks, the management of marketing actions/commercial prospecting related to the use of the engine-bronze.com, the management of transport and deliveries resulting from sales and the management of the payment of orders. The execution of the contract between you and us is the legal basis for this processing. Regarding the management of the product recall, the legal basis of the processing is the legal obligation of engine-bronze.com. Regarding marketing/commercial prospecting actions, the legal basis for processing is, as the case may be, your consent or our legitimate interest.

11.5. Payment Collection and Anti-Fraud

The execution of the contract between you and us and the legitimate interest of moteur-bronze.com, as controller, are the legal bases of this processing.
11.6. Who are the recipients of your data?

For customers, the data is kept in current archives for 5 years from the end of the business relationship, and in intermediate archives for 5 years from the end of the storage in current archives. For credit card data, no storage is made for this data by us.
11.8 Your rights?
11.8.1 You have the right to request access to and rectification of your data, You have the right to request the limitation of the processing of your Data. It is important to note that this right only applies if you dispute the accuracy of your data during the period allowing us to verify the accuracy of the latter, you consider that we unlawfully process your data and that you require a limitation of their use rather than a deletion, we no longer need your data for the purposes of the management of your orders but that thesethese are still necessary for the establishment, exercise or defence of your rights in court, in case of exercise of your right of opposition during the period of verification relating to the point of knowing if the legitimate reasons that we pursue prevail over yours.
11.8.2 Request the deletion of your Data.
In the event of a request to delete your Data, moteur-bronze.com may nevertheless keep them in the form of intermediate archiving, for the period necessary to meet its legal, accounting and tax obligations.
11.8.3 You have the right to withdraw your consent to the processing based on this legal basis.

Section 12 – Liability
The Customer is responsible for the entry and veracity of any information at each stage of his order taking, as well as at all stages after the conclusion of the contract. motor-bronze.com cannot be held responsible for the information provided by the Customer at each stage of its order taking, as well as at all stages after the conclusion of the contract. motor-bronze.com does not guarantee acceptance of the Customer’s order and disclaims all liability in the event of unavailability of the product ordered, subject to reimbursement to the Customer of the price of the product ordered. The only liability of engine-bronze.com under the contract is that set out in Article 11 above. motor-bronze.com shall not be liable for any indirect, special or consequential damages resulting from the contract. engine-bronze.com cannot be held liable in the event that the non-performance of its obligations is attributable to the unforeseeable or insurmountable fact of a third party to the contract, or a case of force majeure as defined by French jurisprudence or a fact outside the control of engine-bronze.com. Moteur-bronze.com cannot be held liable for any inconvenience or damage inherent to the use of the Internet network, including service interruption, external intrusion or the presence of computer viruses. The obligation of engine-bronze.com under the contract is an obligation of means limited to the processing of orders.
Section 13 – Applicable law
These T&Cs are subject to French law. In the event of a dispute, the French courts will have sole jurisdiction. Regulation (EU) No. 524/2103 named ODR (One Line Dispute Resolution) is an independent, impartial and transparent extrajudicial procedure, Efficient, fast and fair dispute resolution for online sales of goods or services between EU countries: http://ec.europa.eu/consumers/odr (the online dispute resolution platform).
Section 14 – Dispute Resolution
The competent court in the event of a dispute shall be that of the place of domicile of the defendant.
Section 15 – Evidence
Computerized records, kept in the computer systems of engine-bronze.com and, where applicable, its partners under reasonable security conditions, will be considered
as evidence of communications, orders and payments between the parties, without prejudice to the possibility for the Customer to report evidence to the contrary by any legally recognized means.

Section 17 – Severability
Any stipulation of the GTC prohibited by or deemed unlawful or unenforceable in accordance with applicable laws and enforced by any court of competent jurisdiction must, within the limits required by law, to be withdrawn from the contractual agreement concerned and to the extent possible declared without effect, without modifying the remaining stipulations. The nullity of all or part of the stipulations of the GCS must in no case cancel or affect the validity of any other stipulation and does not exonerate the Customer from the performance of its obligations.
